THIS PRIVACY POLICY (“POLICY”) EXPLAINS HOW KAADY CAR WASH (“WE”, “US”, AND “OUR”) COLLECTS, USES, SHARES, AND SECURES INFORMATION ABOUT YOU WHEN YOU ACCESS OUR WEBSITE LOCATED AT HTTP://WWW.KAADY.COM (THE “SITE”) AND INTERACT WITH OUR SITE, SIGN UP FOR A KAADY CAR WASH MONTHLY WASH CLUB MEMBERSHIP (“WASH CLUB”) AND INTERACT WITH US THROUGH OUR MOBILE APPLICATION THAT DIRECT TO THIS PRIVACY POLICY (COLLECTIVELY, THE “SERVICES”). THIS POLICY ALSO EXPLAINS THE CHOICES YOU MAY HAVE REGARDING OUR USE OF YOUR INFORMATION.

WE ENCOURAGE YOU TO READ THIS POLICY CAREFULLY AND REVIEW IT PERIODICALLY, AS WE MAY UPDATE AND MAKE CHANGES TO THIS POLICY FROM TIME TO TIME TO REFLECT CHANGES IN THE LAW OR AS WE UPDATE OR EXPAND OUR SERVICES. By using our Services, you acknowledge that we will collect and process your Personal Information in accordance with this Privacy Policy. Further, if you participate in our Wash Club and interact with our mobile application, you consent to the practices and terms set forth in our Wash Club Terms of Use found in the Wash Club mobile application.  If you do not feel comfortable with any part of this Privacy Policy or our Terms of Service, please discontinue use and engagement of Kaady Car Wash Services immediately.

KEY TERMS

Device Information means automatically collected information about your device, including without limitation, information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, Data Information means information about the individual web pages that you view, what websites or search terms referred you to our Site, and information about how you interact with our Site.

Personal Information generally means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. The specific definition of Personal Information depends on the applicable law based on your physical residence. Only the definition that applies to your physical residence will apply to you under this Privacy Policy. 

Process or Processing means an action, operation or set of actions or operations that is performed, automatically or otherwise, on Personal Information or on sets of Personal Information, such as collecting, using, storing, disclosing, analyzing, deleting, or modifying the Personal Information.

Kaady Car Wash collects various information when you interact with our Services while respecting and securing your individual right to personal privacy. We use Cookies to enable and enhance your experience on our website and gather analytics information that helps us improve our Site. We also use Cookies to identify the different devices you use to access our Services, which allows us get a fuller view of your interactions with our Services.

  • Changes To Your Personal Information. We rely on you to ensure that the Personal Information we maintain about you is accurate. If you believe we have incorrect information about you, please submit a request to correct as described below. 
  • Deletion Of Your Personal Information. You may request that we delete your Personal Information. If required by law, we will grant a request to delete information, but you should note that in many situations we must keep your Personal Information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purpose. 
  • WE DO NOT SHARE OR PROCESS PERSONAL INFORMATION FOR TARGETED ADVERTISING, OR PROCESS FOR PROFILING THAT PRODUCES LEGAL OR SIMILARLY SIGNIFICANT EFFECTS, YOUR PERSONAL INFORMATION AND WILL NOT DO SO IN THE FUTURE WITHOUT PROVIDING YOU WITH NOTICE AND AN OPPORTUNITY TO EXERCISE YOUR RIGHTS UNDER APPLICABLE LAW.
  • Online Tracking. We do not currently recognize the “Do Not Track” signal. 
  • Use of Sensitive Information. We will never use or request your sensitive information without obtaining your consent, or in the case of a child, in accordance with the federal Children’s Online Privacy Protection Act (18 U.S.C. § 6501 et seq.).
  • Promotional Text Messages. If you have affirmatively opted in to receiving mobile text messages from us, you may opt out of receiving text messages by texting the word “STOP” in reply to one of our text messages, or by following other unsubscribe instructions provided in the text message. We may send you one additional confirmatory message to let you know that we have received your request.
  • Revocation Of Consent. Where we process your Personal Information based upon consent, you may revoke your consent at any time. Please note, if you revoke your consent for the processing of Personal Information then we may no longer be able to provide you services.

PLEASE NOTE: Not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny your request because the law permits or requires us to do so, or if we are unable to adequately verify your identity, or if these rights are not afforded under the applicable law in your jurisdiction of residence. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal.”

Note that, as required by law, we will require you to verify your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name and email address. We may also ask you to provide a signed declaration confirming your identity. Following a request, we will use reasonable efforts to supply, correct or delete Personal Information about you in our files.

In some circumstances, you may designate an authorized agent to submit requests to exercise certain privacy rights on your behalf. The authorized agent can submit a request on your behalf along with a statement signed by you certifying that the agent is authorized to act on your behalf.

YOUR OREGON PRIVACY RIGHTS

Kaady Car Wash customers who reside in Oregon have certain Personal Information rights under the Oregon Consumer Privacy Act (OCPA).

You have the right to:

  • Confirm whether we are processing or have processed your Personal Information and the categories of that information.
  • Access and obtain a portable copy of all your Personal Information that we have processed or are processing (with proper verification of identity and no more than twice within a 12-month period).
  • Obtain a list of third parties to which we have disclosed your Personal Information or any Personal Information.
  • Correct inaccuracies in your Personal Information.
  • Delete Personal Information provided by or obtained about you.
  • Opt-out of the sale of your Personal Information.

If your request is declined, you may appeal. We are required to respond without undue delay but within forty-five (45) days of receipt of your request. Depending on factors such as the type and complexity of the request, we may extend the time for response once for forty-five (45) additional days but will notify you within the original forty-five (45) day window.

If we decline to act regarding your request, we will notify you within forty-five (45) days of the receipt of the request and explain why.

  • Enough information to identify you (e.g., your full name, address and customer or matter reference number)
  • Proof of your identity and address (e.g., a copy of your driving license or passport and a recent utility or credit card bill); and

You have the right to request that Kaady Car Wash not engage in certain types of automated decision-making about you.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. We will only use Personal Information provided in connection with the verification process to verify your identity or the authority of your authorized agent.

Before accepting a request from an authorized agent, we will require the agent to provide proof that you have authorized the agent to act on your behalf, and we may need you to verify your identity directly with us or confirm that you provided the authorized agent permission to submit the request.

If we deny your request, or you disagree with any action Kaady Car Wash takes or declines to take in relation to your data rights request, you may submit an appeal by contacting us through one of the means listed above.

Sale of Personal Information and Targeted Advertising

Sensitive Personal Information

Kaady Car Wash will request your consent for processing sensitive personal information for purposes other than providing you with a product or service you request, or as required by law. You may revoke your consent at any time. For example, you may revoke your consent to the use of device precise location information through our app by turning off the precise location feature in the app settings on your device.

Kaady Car Wash customers who are residents of California should be aware that California law affords them certain rights regarding their Personal Information. In addition to the rights and choices included above, if you are a California resident, you have the following additional privacy rights with respect to the Personal Information we collect about you.

SHINE THE LIGHT LAW

Subject to certain limits, California Civil Code section 1798.83, permits California residents to ask Kaady Car Wash to provide them with (i) a list of certain categories of Personal Information that we disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties. California residents may make one request per calendar year.

To make this request, you may contact Kaady Car Wash at the email address listed in the “CONTACT US” section below. In your request, please state that you are a California resident and provide a current California address for our response. Please allow up to thirty (30) calendar days for a response. Kaady Car Wash reserves its right not to respond to such requests submitted to an address other than the one specified in the “CONTACT US” section below.

CALIFORNIA CONSUMER PRIVACY ACT

If you are a California resident, you have certain rights regarding information that is treated as Personal Information under the California Consumer Privacy Act of 2018, Cal. Civ. Code §§ 1798.100 et seq. (“CCPA”).

Definitions Specific to California

The CCPA includes definitions for terms specific to this California Privacy Policy that only apply to Kaady Car Wash California residents:

  • Sale means disclosing the Personal Information to a third party for monetary or other valuable consideration.
  • Sharing means disclosure of personal information for Cross-Context Behavioral Advertising.
  • Cross-Context Behavioral Advertising means advertising that is targeted to a consumer based on the consumer's Personal Information obtained from the consumer's activity across businesses, distinctly branded internet websites, applications, or services.

California Residents are entitled to the following rights under the CCPA

1.  The right to know what categories of Personal Information are being collected, sold, or disclosed and the categories of sources of that Personal Information.

You have the right to know what categories of Personal Information we collect, sell, or disclose about you, as well as the categories of third parties who purchased or received your Personal Information and the categories of sources of that Personal Information. These categories are described below in the Categories of California Consumers’ Personal Information Collected, Sold, or Disclosed section below. We are also required to provide to you, before or at the point of collection, with a general notice about the categories of Personal Information collected by us and how we intend to use the collected Personal Information.

2.     The right to access collected Personal Information.

You have the right to request that we provide a copy of your Personal Information that we collected, sold, or disclosed in the preceding twelve (12) months. Only you, or someone you legally authorize to act on your behalf, may make a request related to your Personal Information.

You may submit a maximum of two requests in a twelve (12) month period.

You must provide sufficient information to enable us to reasonably verify your identity or that of your authorized agent. We will only use the Personal Information provided in your request to verify your identity or that of your authorized agent. After receiving and verifying your request, we will provide the following information (depending on your request):

  • The categories of Personal Information collected about you in the preceding twelve (12) months.
  • The sources of that Personal Information by category.
  • The business or commercial purpose(s) for collecting or selling that Personal Information.
  • The categories of third parties with whom we shared that Personal Information.
  • The specific pieces of Personal Information collected about you.

3.     The right to request deletion of Personal Information.

With certain exceptions, you have the right to request that we and our service providers delete Personal Information we or our service provider collected or maintained. Once we receive and verify your request, we will delete and instruct any applicable service providers to delete your Personal Information from our records, unless an exception applies.

We and our service providers may deny a verified deletion request if we must maintain your Personal Information to:

  • Complete the transaction or provide a good or service requested by you for which we collected the Personal Information, or otherwise perform a contract between us.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity.

4.     The right to opt-out of the sale of Personal Information.

You have the right to opt-out of the “sale” of your Personal Information to other businesses or third parties. Notwithstanding, WE DO NOT SHARE YOUR PERSONAL INFORMATION AND WILL NOT DO SO IN THE FUTURE WITHOUT PROVIDING YOU WITH NOTICE AND AN OPPORTUNITY TO EXERCISE YOUR RIGHTS UNDER APPLICABLE LAW.

5.     The right to be free from discrimination.

You have the right to equal service, and we will not discriminate against you if you exercise your rights under the CCPA.

6.     The rights of California consumers who are less than 16 years of age.

Under California law, consumers who are less than 16 years of age must provide affirmative authorization before a business may sell their Personal Information. This is referred to as the “right to opt-in.”

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any Personal Information on the Website. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use this Website, provide any information on this Website, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. California Sensitive Information Disclosure

We may collect the following categories of sensitive Personal Information, as defined under California law: account log-in information, passwords, or payment information. This information is collected in order to process transactions, comply with laws, manage our business, or provide you with services. Methods for Submitting CCPA Requests to Kaady Car Wash

You have the right to submit a verifiable request to us by contacting us through one of the methods listed in the CONTACT US section below.

Use of Authorized Agents

An authorized agent is either a natural person or a business entity registered with the California Secretary of State that a consumer has authorized to act on his or her behalf.

You may use an authorized agent to submit a request to know, to delete or to opt-out. You may make such a designation by providing the agent with written permission to act on your behalf. We will require the authorized agent to provide either (1) a power of attorney; or (2) proof of your signed permission. In addition to proof of your written permission, we may require you to verify your own identity and directly confirm that you provided the agent permission to submit the request.

Response Timing and Format

We will respond to a verifiable request from you within forty-five (45) calendar days. If we cannot respond in that time, we will notify you in writing that we need an additional forty-five (45) calendar days and explain the reason for the needed additional time.

Any disclosures we provide will cover only the 12-month period preceding our receipt of your verifiable request. If we cannot comply with your request, we will explain why.

If you have requested to know specific Personal Information we collected (for data portability requests) we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why and provide you with a cost estimate before completing the request.

Acting upon opt-out requests

We will act upon an opt-out as soon as commercially reasonable, but no later than fifteen (15) business days from the date we receive the request.

Do Not Share My Personal Information

In the event that Kaady Car Wash decides to sell your Personal Information, you have the right to direct us not to do so, and you may exercise this right at any time. Once you opt-out, we will not sell your Personal Information unless you give us authorization to do so. We will not ask you to reauthorize such sales until twelve (12) months have passed since complying with request to opt-out.

Value of California Consumers’ Personal Information

We do not assign a monetary value to the Personal Information that we collect and strive to only use that information to further our business in accordance with this Policy. To the extent that we are required to assign a monetary value to your Personal Information, it is equal to the value of the discount or financial incentive that we have provided to you.
